PAYMENTS AND REFUNDS
The Client, understood as the person purchasing this Offer, understands that the cost of the Offer is non refundable. Payment must be made in advance of receiving access to the Offer. If you choose to pay via a payment plan and your monthly payment fails for any reason, you will immediately lose access to the program content until the issue has been remedied.

DISCLAIMERS

The Client understands that the role of the Holistic Nutritionist (the Coach) is not to prescribe or assess micro- and macronutrient levels; provide health care, medical or nutrition therapy services; or to diagnose, treat or cure any disease, condition or other physical or mental ailment of the human body. Rather, the Coach is a mentor and guide who has been trained in holistic health coaching, nutrition, and a functional medicine approach to help clients reach their own health goals by helping clients devise and implement positive, sustainable lifestyle changes. The Client understands that the Coach is not acting in the capacity of a doctor, licensed dietitian, psychologist or other licensed or registered professional, and that any advice given by the Coach is not meant to take the place of advice by these professionals.

If the Client is under the care of a healthcare professional or currently uses prescription medications, the Client should discuss any dietary changes or potential dietary supplements use with his or her doctor, and should not discontinue any prescription medications without first consulting his or her doctor. The Client has chosen to work with the Coach and understands that the information received should not be seen as medical or nursing advice and is not meant to take the place of seeing licensed health professionals.

​​Should the Client request the Coach to recommend dietary changes and/or nutritional supplements to enhance the Client’s body’s natural ability to resist and/or overcome a known disease, disorder or condition, it is the Client’s responsibility to disclose the nature of the disease, disorder or condition and all other relevant details to the Coach. If the Client has not previously consulted a licensed Physician or Naturopath about this disease, disorder or condition, the Client acknowledges that they are directed to promptly do so. The Client agrees not to alter or discontinue treatments prescribed by a licensed Naturopath, Physician or other licensed health professional without consulting the individual who prescribed the treatment.

The Coach does not diagnose, treat, or manage medical conditions, nor do they provide care for emergencies, urgent symptoms, or acute health crises. The Coach is not a licensed medical provider and is not on call for emergency care.

If the Client is experiencing severe symptoms, a medical emergency, or a health concern that requires immediate attention, it is the Client’s sole responsibility to seek care through the appropriate channels. This may include calling 911, visiting the nearest emergency room, or contacting your primary care provider.

Please do not email or message the Coach asking whether or not you should seek medical attention for an emergency or acute symptoms, as the Coach is not equipped or authorized to make that judgment.

By working with the Coach, the Client acknowledges and agrees that they are responsible for managing any medical emergencies or urgent health concerns independently, outside the scope of this program.

The Coach is not responsible and cannot be held liable for accidental pregnancy that may occur after purchasing this Offer if the Client chooses to discontinue use of hormonal birth control during or after the program. This Offer is purely for educational purposes only and is not a guarantee of results.

COPYRIGHTED INFORMATION
The Client agrees to refrain from copying, disclosing, using, selling, or offering for sale any and all of the Offer. The information included in the Offer is for personal use only and cannot be transferred to others, shared for free or for profit, or distributed on any public platform without explicit written permission and additional payment to the Coach.

PERSONAL RESPONSIBILITY AND RELEASE OF HEALTH CARE RELATED CLAIMS
The Client acknowledges that the Client takes full responsibility for the Client’s life and well-being, as well as the lives and well-being of the Client’s family and children (where applicable), and all decisions made during and after this Offer. The Client expressly assumes the risks of the offer, including the risk of pregnancy. The Client releases the Coach from any and all liability, damages, causes of action, allegations, suits, sums of money, claims and demands whatsoever, in law or equity, which the Client ever had, now has or will have in the future against the Coach, arising from the Client’s past or future participation in, or otherwise with respect to, the offer, unless arising from the gross negligence of the Coach.

CONFIDENTIALITY
The Coach will keep the Client’s information private, and will not share the Client’s information to any third party unless compelled to by law.

ARBITRATION, CHOICE OF LAW, AND LIMITED REMEDIES
In the event that there ever arises a dispute between Coach and Client with respect to the services provided pursuant to this agreement or otherwise pertaining to the relationship between the parties, the parties agree to submit to binding arbitration before the American Arbitration Association (Commercial Arbitration and Mediation Center for the Americas Mediation and Arbitration Rules). Any judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Such arbitration shall be conducted by a single arbitrator. The sole remedy that can be awarded to the Client in the event that an award is granted in arbitration is a refund of the Offer Fee (less the cost of credit card processing fees). Without limiting the generality of the foregoing, no award of consequential or other damages, unless specifically set forth herein, may be granted to the Client.

This agreement shall be construed according to the laws of the State of Arizona. In the event that any provision of this Agreement is deemed unenforceable, the remaining portions of the Agreement shall be severed and remain in full force.

By purchasing this Offer, and checking the box that you "Agree to the Terms and Conditions" you are confirming that the terms of this Agreement are acceptable. You, the Client, acknowledges that: (1) he/she has received a copy of this letter agreement; (2) he/she has had an opportunity to discuss the contents with the Coach and, if desired, to have it reviewed by an attorney; and (3) the client understands, accepts and agrees to abide by the terms hereof.
