PAYMENTS AND REFUNDS
The Client, understood as the person purchasing this Offer, understands that the cost of the Offer is non refundable. Payment must be made in advance of receiving access to the Offer. If you choose to pay via a payment plan and your monthly payment fails for any reason, you will immediately lose access to the program content and membership community until the issue has been remedied.
This program has a 120-day money back guarantee. In order to request a refund, you must have completed all 12 of the training modules, attended live or watched the recording of all of the coaching calls during that time, and have been an active participant in the private community group to show that you were engaged in the program, asking for help when you needed it, and committed to making positive, lasting changes for your health and hormones! If after completing the program in its entirety within 120 days, you truly didn't see any positive changes in your health, hormones, or body, you can contact Real Health with Rach directly to request a refund.
COPYRIGHTED INFORMATION
The Client agrees to refrain from copying, disclosing, using, selling, or offering for sale any and all of the Offer. The information included in the Offer is for personal use only and cannot be transferred to others, shared for free or for profit, or distributed on any public platform without explicit written permission and additional payment to the Coach.
DISCLAIMERS
The Client understands that the role of the Health Coach is not to prescribe or assess micro- and macronutrient levels; provide health care, medical or nutrition therapy services; or to diagnose, treat or cure any disease, condition or other physical or mental ailment of the human body. Rather, the Coach is a mentor and guide who has been trained in holistic health coaching to help clients reach their own health goals by helping clients devise and implement positive, sustainable lifestyle changes. The Client understands that the Coach is not acting in the capacity of a doctor, licensed dietitian, psychologist or other licensed or registered professional, and that any advice given by the Coach is not meant to take the place of advice by these professionals.
If the Client is under the care of a healthcare professional or currently uses prescription medications, the Client should discuss any dietary changes or potential dietary supplements use with his or her doctor, and should not discontinue any prescription medications without first consulting his or her doctor. The Client has chosen to work with the Coach and understands that the information received should not be seen as medical or nursing advice and is not meant to take the place of seeing licensed health professionals.
Should the Client request the Coach to recommend dietary changes and/or nutritional supplements to enhance the Client’s body’s natural ability to resist and/or overcome a known disease, disorder or condition, it is the Client’s responsibility to disclose the nature of the disease, disorder or condition and all other relevant details to the Coach. If the Client has not previously consulted a licensed Physician
or Naturopath about this disease, disorder or condition, the Client acknowledges that they are directed to promptly do so. The Client agrees not to alter or discontinue treatments prescribed by a licensed Naturopath, Physician or other licensed health professional without consulting the individual who prescribed the treatment.
PERSONAL RESPONSIBILITY AND RELEASE OF HEALTH CARE RELATED CLAIMS
The Client acknowledges that the Client takes full responsibility for the Client’s life and well-being, as well as the lives and well-being of the Client’s family and children (where applicable), and all decisions made during and after this program. The Client expressly assumes the risks of the Program, including the risks of trying new foods or supplements, and the risks inherent in making lifestyle changes. The Client releases the Coach from any and all liability, damages, causes of action, allegations, suits, sums of money, claims and demands whatsoever, in law or equity, which the Client ever had, now has or will have in the future against the Coach, arising from the Client’s past or future participation in, or otherwise with respect to, the Program, unless arising from the gross negligence of the Coach.
The Client hereby accept all risk to their health, including injury or death that may result from such participation and I hereby release the Coach on my behalf and on behalf of my personal representatives, estate, heirs, next of kin, and assigns from any and all costs, claims, causes of action and damages arising from any and all illness or injury to my person, including my death, that may result from or occur as a result of my participation in the Coach’s services, whether caused by negligence or otherwise.
The Client understands that any therapies they undertake while working with the Coach are undertaken of their own free will. The Client accepts that the ultimate responsibility for their health care is their own and the Coach is here to support in this. The Client understands that the Coach reserves the right to determine which cases fall outside their scope of practice, in which event an appropriate referral will be recommended. The Client hereby agrees to assume full responsibility for any manner of loss, injury, claim or damage whatsoever, known or unknown, incurred as a result of same and the Client, their heirs, executors, administrators or assigns for any loss, injury, claim or damage sustained as a result of my attendance and/or participation. The Client has read the above release and waiver of liability, and fully understands its contents and voluntarily agrees to the terms and conditions stated.
CONFIDENTIALITY
The Coach will keep the Client’s information private, and will not share the Client’s information to any third party unless compelled to by law. The Client understands that they will be communicating via Kajabi, Zoom, and email with the Coach, which may sometimes include sensitive personal and health related information and that these are not secure communication channels. The Client may choose to share lab work with the Coach via email, and if so, accepts all risks of sharing personal health information via unsecured email.
The Client agrees to refrain from copying, disclosing, using, selling, or offering for sale any and all of the content shared during the Offer. The information included in the Offer is for personal use only and cannot be transferred to others, shared for free or for profit, or distributed on any public platform without explicit written permission and additional payment to the Coach.
In providing services to the Client, the Coach is relying upon the truth, accuracy and completeness of all information provided. Any recommendations the Client follows for changes in diet, including the use of nutritional supplements, are entirely their responsibility.
ARBITRATION, CHOICE OF LAW, AND LIMITED REMEDIES
In the event that there ever arises a dispute between Coach and Client with respect to the
services provided pursuant to this agreement or otherwise pertaining to the relationship
between the parties, the parties agree to submit to binding arbitration before the American
Arbitration Association (Commercial Arbitration and Mediation Center for the Americas
Mediation and Arbitration Rules). Any judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Such arbitration shall be conducted by a single arbitrator. The sole remedy that can be awarded to the Client in the event that an award is granted in arbitration is a refund of the Offer Fee (less the cost of the lab test). Without limiting the generality of the foregoing, no award of consequential or other damages, unless specifically set forth herein, may be granted to the Client.
This agreement shall be construed according to the laws of the State of Arizona. In the event that any provision of this Agreement is deemed unenforceable, the remaining
portions of the Agreement shall be severed and remain in full force.
By purchasing this Offer, and checking the box that you "Agree to the Terms and Conditions" you are confirming that the terms of this Agreement are acceptable. You, the Client, acknowledges that: (1) he/she has received a copy of this letter agreement; (2) he/she has had an opportunity to discuss the contents with the Coach and, if desired, to have it reviewed by an attorney; and (3) the client understands, accepts and agrees to abide by the terms hereof.
